Benjamin W. Hutton

Ben Hutton focuses his practice on commercial real estate transactions, advising on the acquisition, development, leasing, sale and financing of a range of properties. He has represented buyers and sellers of office, industrial and retail properties, including purchasers in transactions spanning multiple properties and states. His development work includes representing residential developers of detached housing and condominiums.

Ben also represents lenders in lending and real estate finance matters. His work includes negotiating and documenting construction and permanent loans, as well as handling loan restructurings and modifications. Commercial lending and general commercial transactions are also among his primary areas of practice.

As a title agent, Ben issues title insurance policies throughout Alabama for several title insurance companies, including Fidelity National Title Insurance Company and First American Title Insurance Company.

• $125 million chemical facility - Local counsel for a foreign chemical firm establishing an approximately $125 million chemical facility in North Alabama.
• $130 million institute - Represented a non-profit biotechnology institute in its land acquisition for the establishment of approximately $130 million institute.
• $40 million acquisition and construction financing - Represented lender in connection with a $40 million acquisition and construction financing for a multifamily development.
• $24.5 million refinance - Represented borrower in connection with $24.5 million refinance of office building.
• Sale of 200,000+ Square Foot Warehouse Facility by Space Park Properties Partnership - Represented Space Park Properties Partnership is the sale of a 200,000+ square foot warehouse facility and 11.257 acres in Goodlettsville, Tennessee.
• Foreclosure and Collection Activities on Mixed Residential and Commercial Development - Represented bank lender in workout discussions and ultimately foreclosure and collection proceedings against mixed-use $10 million residential/commercial property, including repurchase of loan participation from FDIC and evaluation of redemption/foreclosure options to help client maximize recovery and minimize likelihood of owner redemption of property.
