Overview
Marcy Levine Aldrich focuses her complex litigation practice on disputes involving national and regional insurers. She has defended insurers in cases concerning homeowners, automobile, personal articles, disability, life and commercial lines insurance. Her experience spans questions about statutory notice requirements, policy deductibles and subrogation claims, as well as the handling of uninsured motorist claims, hurricane claims under homeowners’ policies and vehicle total losses. She has also litigated a range of issues arising under the Florida No-Fault (PIP) Statute.
Class action defense is a substantial part of Marcy’s practice. She has defended more than 500 class actions in state and federal courts throughout the United States and chairs Akerman’s Class Action Defense Litigation Practice. For insurers, she handles class actions involving underwriting, coverage, insurance agency and disability insurance issues, along with disputes over claims handling. Her broader class action experience includes complex commercial disputes concerning tax, securities, warranties, products liability, RICO and contracts.
Marcy’s insurance litigation practice also extends beyond class actions. She prosecutes and defends significant appeals for insurers in state and federal appellate courts and defends them against extra-contractual and bad faith claims in state and federal courts. Chambers USA has noted her “strong reputation.”
