Overview
Bryony Swift is a shareholder in Becker & Poliakoff’s Condo, Co-Op & HOA practice group. She represents condominium and homeowner associations in general counsel matters and dispute resolution, advising on corporate governance, regulatory and owner compliance, governing documents and day-to-day operations. Her work includes responding to violations within communities and helping associations address disputes. A former litigator, Bryony has experience with the legal process from intake through post-trial motions, including class action litigation. She draws on that courtroom experience when assessing how to respond to community violations.
Bryony’s community association practice combines advice on existing obligations with the preparation and revision of governing documents. She reviews and interprets statutes, case law, administrative code provisions, contracts, easements and other legal materials. Her drafting work includes original, amended and restated condominium declarations; homeowner association declarations; articles of incorporation; association bylaws; and declaration amendments. Where anticipated changes in the law are expected to benefit associations, she takes those changes into account in drafting documents.
Her involvement in the Florida Legislative Alliance and the Community Association Leadership Lobby informs her work with associations on prospective changes in the law and gives her opportunities to support legislation beneficial to them. Bryony is a current council member and former delegate of the Florida Legislative Alliance, a member of the Community Association Leadership Lobby, and a member of the Florida Bar’s Real Property and Trust Law Section Condominium and Planned Development Committee. She has also served as president of the Young Lawyers’ Division of the Manatee County Bar Association; on the boards of the Manatee County Bar and the Manatee Chapter of the Florida Association for Women Lawyers; and as chair of the first Young Professionals’ Committee within Community Association Institute.
