Erin Illman advises companies on privacy, data security and the legal questions that arise when technology becomes part of business operations. A Board Certified Specialist in Privacy and Information Security Law recognized by the State of North Carolina, she co-chairs Bradley’s Cybersecurity and Privacy Practice Group and leads the firm’s Fintech team. Her work spans privacy compliance, the development of digital products and services, security incidents, and privacy-related disputes and enforcement actions.
Erin advises on U.S. and international private-sector privacy requirements, including rules governing transfers of sensitive personal data between the United States, the European Union and other jurisdictions. She helps clients assess how they handle sensitive information, develop privacy policies and consumer-facing notices, review third-party agreements and vendor oversight, and establish privacy and security programs, including programs involving domestic and offshore vendors.
When an incident or dispute arises, Erin represents companies in response efforts, privacy-related litigation and enforcement matters. Her incident work includes insider cybersecurity threats, electronic and physical theft of trade secrets, and the investigation, analysis and notification associated with security incidents and breaches. She also handles disputes and enforcement actions involving alleged data privacy violations.
Erin’s technology counseling extends to e-commerce, electronic marketing, digital contracts and the launch of new products and services. She advises on privacy compliance for existing offerings and marketing activities, as well as electronic transactions under ESIGN and UETA. Her work for technology and e-advertising clients includes questions about the use and disclosure of consumer information under state and federal law, including TCPA, UDAAP/UDAP and associated FTC rules. She has assisted clients with products and services involving electronic identities, digital vaults, automated operations and cloud storage, and advises on legal obligations associated with social media, mobile applications, cryptocurrencies, digital ledger technology and biometric authentication.
Erin also brings experience in commercial and consumer lending. She has worked on trade finance, capital-backed subscription lines, and multi-bank, multi-state and international lending arrangements. Her consumer lending experience includes transactions, regulatory compliance disputes, enforcement defense, internal risk assessment and debtor-creditor matters, including remedies, Uniform Commercial Code issues, fraud and tort counterclaims, credit risk management and loss mitigation.
