Overview

Jessica C. Kaiser focuses on patent litigation and challenges to issued patents, drawing on more than two decades of experience in complex intellectual property disputes. As global head of the firm’s Patent Litigation practice and co-head of its Post Grant Proceedings practice, Jessica represents established and emerging companies in the technology, telecommunications and life sciences sectors. Her work includes litigation as well as inter partes reviews, post-grant reviews and ex parte reexaminations.

Jessica has practiced before U.S. district courts and the International Trade Commission and has served as a lead administrative patent judge at the U.S. Patent and Trademark Office. At the USPTO, she managed and decided numerous Patent Trial and Appeal Board matters, including inter partes reviews, post-grant reviews and ex parte appeals arising during patent prosecution. She also worked with USPTO and PTAB leadership on reforms involving agency rulemaking, a pilot program for motions to amend claims during AIA trials, PTAB statistics and remote hearing operations.

Before her USPTO service, Jessica was a partner at another large international law firm, where she focused on patent litigation in district court and before the International Trade Commission. She also served as a staff attorney in the Office of General Counsel at the U.S. Court of Appeals for the Federal Circuit, advising the court on mandamus petitions and motions filed before assignment to a merits panel. Earlier, she clerked for Judge Paul R. Michel of the Federal Circuit and Judge Joan B. Gottschall of the U.S. District Court for the Northern District of Illinois.

Since returning to private practice in 2022, Jessica has served as counsel in more than 100 PTAB proceedings. She is ranked for IP: Patent Trial and Appeal Board in Chambers USA and is recognized in the IAM Patent 1000.
